Shana Horton

Shana L. Horton is a native Austinite and graduate of the University of Texas School of Law with recognized expertise in environmental and administrative law.  She is a chapter co-author of a major water law reference book published by the State Bar of Texas and Past Chair of the Environmental Section of the Austin Bar Association. As a former staff attorney for the Texas Commission on Environmental Quality, she has in- depth knowledge of TCEQ practices and procedures and established relationships with TCEQ and Texas Water Development Board staff, attorneys, and managers.


Experience

  • Assisted with representation of protestant party in major water right application hearing before the State Office of Administrative Hearings;
  • Represented protestant party in unprecedented water rights-related emergency order hearing before the State Office of Administrative Hearings;
  • Monitor regulatory authority activities, provide research, analysis and advice, and represent non- profit group in matters related to the management of water in the lower Colorado River basin;
  • Legislative monitoring and analysis; development and pursuit of legislative agenda related to water management and use;
  • Endangered Species Act analysis and advice;
  • Surface water rights matters, including permit and permit amendment applications, representation of protestant clients in contested case hearing proceedings, and regulatory compliance analysis;
  • Groundwater-related work, including groundwater well permitting, groundwater conservation district rulemaking, and monitoring of district and groundwater management area (GMA) activities and development of desired future conditions; analysis and provision of advice regarding use and ownership of groundwater wells; experimental well permitting;
  • Solid waste permitting matters, including representation of protestant to controversial proposed municipal solid waste landfill;
  • Remediation-related projects, including development of institutional controls for Superfund site and procurement of "no further action" letter from regulatory authority;
  • Development and drafting of contracts for surface and groundwater use and supply;
  • Water reuse permitting and contracts;
  • Regulatory compliance consultation;
  • Practiced in the TCEQ water utilities and districts, surface water rights, and solid waste sections;
  • Represented the Executive Director in enforcement litigation before the State Office of Administrative Hearings in cases involving all environmental media;
  • Represented the Executive Director in numerous contested case hearings regarding permit applications before the State Office of Administrative Hearings;
  • Represented the Executive Director at Commission agenda meetings;
  • Lead Attorney on several rulemaking projects;
  • Participated in the TCEQ Aspiring Leaders Program, 2010 – 2011 (one staff member from the Office of Legal Services is selected for each class).
